1.1. https://srilankatransfer.de operates a booking portal for transfer services and car rentals with driver in Sri Lanka. The user of the portal can check the availability of transfers and rental cars with driver from various transfer companies (collectively referred to as "providers") according to the entries made by you. Furthermore, the user can conclude a contract for the transportation selected by you with the respective provider.

1.2. srilankatransfer.de acts exclusively as an agent for the transportation services of the respective providers and arranges contracts in the name and for the account of the providers. Between srilankatransfer.de and the user, in the case of a booking of a transportation service, an agency agreement is concluded, the object of which is the mediation of the transportation service.

1.3 By registering, you make a binding offer to the selected provider to conclude a transportation contract. The contract is concluded by acceptance by the selected provider or by acceptance by srilankatransfer.de on behalf of the provider. The contract is also concluded when srilankatransfer.de or the respective provider sends an invoice to the customer.

1.4 The brokered contract is based on the provider's own General Terms and Conditions (GTC). These regulate payment terms, provisions on due dates, liability, etc. as well as other restrictions and obligations of the user. The corresponding GTC of the provider are made available to the user on the website for inspection and acceptance.

1.5 The text of the contract and the order data are stored for the purpose of processing the contractual relationship and forwarded to the selected contractual partners (e.g. transport companies, credit card companies, etc.) by way of contract processing.

  1. Obligations of the customer
    Defects in the brokerage service must be reported to srilankatransfer.de immediately. If the user culpably fails to notify srilankatransfer.de of a defect, any claims of the user arising from the brokerage contract shall lapse, unless it is a matter of injury to life, limb or health.
  2. Booking processing
    The provider's price stated in the booking confirmation is binding. srilankatransfer.de is authorized to accept and collect the claim. Payment is possible by credit card (Visa or MasterCard), PayPal and bank transfer. In the case of payment by credit card, the amount is due upon conclusion of the contract and will be debited from the specified credit card at this time.

4. liability of srilankatransfer.de
4.1 The individual details of the transportation services are based on the information provided by the providers.
A guarantee for this is not assumed by srilankatransfer.de. This does not apply if srilankatransfer.de was aware or should have been aware of erroneous and/or incorrect information. In this respect, liability for knowledge of such circumstances is limited to cases of intent and gross negligence.

4.2. srilankatransfer.de shall not be liable for the success of the placement and/or the actual proper provision of the transportation service itself.

4.3 Furthermore, srilankatransfer.de is only liable for damages that do not involve injury to life, limb or health in cases of intent and gross negligence. This also applies to liability for guarantees assumed or liability for the breach of essential contractual obligations. In the event of negligent breach of cardinal obligations, liability shall be limited to foreseeable damage typical of the contract. In any case, unless injury to life, limb or health is involved, liability is limited to three times the value of the transportation service provided. Furthermore, liability for the consequences of force majeure, orders by authorities, civil unrest, hijacking, terrorist attacks, fire, floods, power failures, accidents, storms, strikes, lockouts or other industrial action affecting urlaubstransfers.de or its suppliers is excluded.

  1. Choice of law and place of jurisdiction
    The contractual relationship between the customer and srilankatransfer.de is governed exclusively by German law. Insofar as German law is not applied on the merits in the event of legal action by the customer against us abroad for our liability, German law shall apply exclusively with regard to the legal consequences, in particular with regard to the nature, scope and amount of the customer's claims.

General Terms and Conditions of the carrier (provider)

  1. Conclusion of the contract and payment
    With the registration you offer us the conclusion of a binding transportation contract. The contract is concluded upon acceptance by us or by srilankatransfer.de on our behalf. Together with our confirmation, you will also receive your transfer voucher by e-mail.

Payment is due on booking and can be made by credit card (Visa or MasterCard) or by SOFORT bank transfer and PayPal.

The amount will be debited by us or srilankatransfer.de from the credit card or account specified by you upon conclusion of the contract.

We provide the booked transfers as follows:

- Transfer airport/hotel
For the booked airport and arrival time from the airport to the hotel, a waiting time of up to 60 minutes from the booked arrival time for the transfer is agreed as reasonable.
The transportation price includes one suitcase and one piece of hand luggage per person. In addition, one child's buggy can be carried free of charge per booking.
Special baggage, sports baggage and additional suitcases can be carried for a fee, provided you have selected this when booking the transfer.
Child seats and booster seats can be ordered additionally. It is the responsibility of the person making the booking to order these.

- Transfer hotel/airport
The pick-up time from the hotel will be determined by the local service provider, taking into account the departure time communicated to us. You will receive information about the exact pick-up time at the hotel 24 hours before departure. A service hotline is available for this purpose. Please refer to the travel documents for details. The arrival and departure times stated in the booking documents are binding.
The transportation price includes one suitcase and one piece of hand luggage per person. In addition, one child's buggy can be carried free of charge per booking.
Special baggage, sports baggage and additional suitcases can be carried for a fee, provided you have selected this when booking the transfer.
Child seats and booster seats can be ordered additionally. It is the responsibility of the person making the booking to order these.

- Tour transfer
A tour transfer is a journey between two or more locations. The tour transfer can be booked on a daily basis. A transportation service from A to B is arranged. If more locations are booked (e.g. from A to B and on to C and possibly D), the minimum overnight stay may be one night.
The pick-up time from the hotel is determined by the local service provider, taking into account the circumstances. Tour guide services are not included.
Tour transfers do not apply to airport transfers.
The transportation price includes one suitcase and one piece of hand luggage per person. In addition, one child's buggy can be carried free of charge per booking.
Special baggage, sports baggage and additional suitcases can be carried for a fee, provided you have selected this when booking the transfer.
Child seats and booster seats can be ordered additionally. It is the responsibility of the person making the booking to order these.
Tour transfers do not apply to airport transfers.

- Hourly rental of vehicle with driver
For hourly bookings or excursions, the journey must always end in the city area of the pick-up location. An hourly booking always begins at the booked pick-up time and includes a mileage limit.
The pick-up time from the hotel is determined by the local service provider, taking into account the circumstances.
The transportation price includes one suitcase and one piece of hand luggage per person. In addition, one child's buggy can be carried free of charge per booking.
Special baggage, sports baggage and additional suitcases can be carried for a fee, provided you have selected this when booking the transfer.
Child seats and booster seats can be ordered additionally. It is the responsibility of the person making the booking to order these.
Tour guide services are not included.
Hourly bookings are not valid for airport transfers.

- Charter trips (flat-rate trips)
Charter trips are trips at a fixed price over several days. Minimum period: three days. The route must be specified by the guest. The driver's driving time, including breaks, must not exceed 7 hours. Accommodation costs for the driver are already included in the price.
The pick-up time from the hotel is determined by the local service provider, taking into account the circumstances. Tour guide services are not included.
Charter trips (flat-rate trips) do not apply to airport transfers.
The transportation price includes one suitcase and one piece of hand luggage per person. In addition, one child's buggy can be carried free of charge per booking.
Special baggage, sports baggage and additional suitcases can be carried for a fee, provided you have selected this when booking the transfer.
Child seats and booster seats can be ordered additionally. It is the responsibility of the person making the booking to order these.
Charter trips are not valid for airport transfers.

3. changes in performance
A change of services after conclusion of the contract at your request is only possible in the following cases:
You can make changes to the flight details on the desired travel date yourself via www.srilankatransfers.de if you have opened a customer account. Otherwise, please notify us by e-mail, stating the booking number and the name of the person making the booking.
Changes are possible up to 48 hours before scheduled arrival. In the event of non-notification of changed flight data, our obligation to provide transportation shall lapse.

If you are informed by your airline or tour operator of a change to the return flight dates, please contact our local service provider immediately to reschedule the pick-up time. Please refer to the travel documents for the dates.

The travel date can be postponed by a maximum of three days.
It is not possible to change the destination, the mode of transportation or the destination airport.

  1. Prices and price changes
    The prices are calculated on a daily basis and can be changed at any time prior to the conclusion of the booking without prior notice, but not retroactively with regard to contracts already concluded.
    In very rare cases, fees, taxes or price increases for fuel (i.e. tolls, VAT or other taxes, price increases for gasoline or diesel, etc.) may be subsequently introduced or increased in the period between the issued booking confirmation, i.e. the conclusion of the contract and the start of the contract, over which Srilankatransfer.com and the providers have no influence and could not have foreseen at the time of the conclusion of the contract with the customer. In these rare cases, srilankatransfer.co.uk has the right to demand these subsequently introduced or levied fees or taxes or the price increases from the customer in addition to the price stated in the contract, if there is a period of at least four months between the time the voucher is sent to the customer and the start of the contract. If srilankatransfer.de makes use of this right on behalf of the provider before the start of the contract and demands payment of such fees or taxes or price increases, the customer has the right to withdraw from the contract in writing or in text form (e-mail to support@srilankatransfer.de is sufficient) within two weeks of receiving the request for an increase from srilankatransfer.de, but no later than the day before the start of the contract. The customer will then be reimbursed immediately for any payments already made on the contract; the customer should therefore state his bank account details in any letter of withdrawal. The customer cannot make any further claims in such a case. The burden of proof for the existence of the conditions of the right to increase the price according to this paragraph lies with srilankatransfer.de and the providers. If the customer does not exercise the right to withdraw from the contract in time, this is deemed to be tacit agreement with the price increase; srilankatransfer.de therefore acquires an additional claim for payment against the customer in this case. In the event of any subsequent request for payment, srilankatransfer.de will expressly point this out to the customer in writing or in text form. Price changes or changes to the conditions are possible at any time and without prior notice for reservations not yet confirmed by sending a voucher, i.e. until the conclusion of the contract. In addition, we reserve the right to change prices (as listed above).
  1. Termination
    You can withdraw from the contract at any time before the start of transportation. To avoid misunderstandings, the withdrawal should be declared in writing. Failure to start will be treated as a withdrawal. The date of withdrawal is determined by the date on which we receive the declaration of withdrawal. If you withdraw from the contract or do not take up the transportation services, we can demand compensation for our expenses and the travel arrangements made. You expressly reserve the right to prove to us that no loss or only a significantly lower loss has been incurred:
    - up to 72 hours before the start of the transportation service EUR 34.00 / per booking
    - 100 % thereafter and if the transportation service is not commenced.
  1. Limitation of liability
    Our liability for contractual claims for damages is limited to a total of three times the transportation price, provided that the damage was not caused intentionally or through gross negligence by us or a service provider and does not involve physical injury.
    You are liable for the provision of complete and correct flight information. If this information is not correct, any claim for transportation is void and claims for damages against us are excluded. you will find our address in the travel documents.

According to EU Regulation No. 524/2013 on online dispute resolution for consumer disputes, as of January 9, 2016, consumers have the option of settling disputes with traders in connection with online sales contracts or online service contracts out of court via an online platform (ODR platform). If you have concluded a service contract with us (this is the case if you have booked here), this regulation applies. This platform is set up by the EU Commission and made accessible in particular via the "Your Europe" portal (http://europa.eu/youreurope/citizens/index_de.htm ).

Tip from srilankatransfer.de:

We recommend that you take out travel cancellation insurance. Under www.privatreiseschutz.de and under www.urlaubsreiseschutz.de you can insure all your travel costs against cancellation in the event of unforeseeable events. Simply add all your travel costs to one trip price. This insurance allows you to do this.

5. limitation of liability

You are liable for the provision of complete and correct flight information. If this information is not correct, any claim for transportation is void and claims for damages against us are excluded.
